School Committee loses Open Meeting Law decision

The Attorney General issued an OML decision on April 28 in a case in which the School Committee was found to have committed the following violations:

  1. The Board improperly entered an executive session under Purpose 7 (to protect the privacy of an individual under discussion) because the issue discussed was not protected by the statutory right to privacy.
  2. The Committee improperly entered Executive Session when a member other than the Chair stated the purpose for the Executive Session.
  3. The topic “Personnel Matter” in the Committee’s posted notice was insufficiently specific.

Because the Committee had been found in violation of the last of these (insufficient specificity) previously, the AG determined this violation was intentional.
